Optimum WiFi Terms of Use for Subscribers -

CSC Holdings, LLC ("Optimum") is pleased to make its community WiFi networks, including Optimum WiFi, Optimum WiFi Passpoint, and Optimum WiFi (collectively the "Community WiFi Networks."), available to Optimum Subscribers, Suddenlink Customers and other authorized users in accordance with these Terms of Use ("Terms"). For Optimum Subscribers, these Terms incorporate the General Terms and Conditions of Service, available at:

Your use of any Community WiFi Network is your acknowledgment that you have read and agreed to these Terms.

 

Access to and Use of Community WiFi Networks

You understand that the Community WiFi Networks are a feature of Optimum's Optimum Internet service.

In order to access a Community WiFi Network, you must provide your Optimum login credentials. You acknowledge and agree that you will be responsible for all activities during any session using a Community WiFi Network. You may not provide any third party with your credentials for the purpose of accessing a Community WiFi Network. You may use the Community WiFi Networks solely for your own lawful personal purposes in accordance with the relevant Acceptable Use Policy. You may not in any way distribute, resell or otherwise provide third parties with access to or use of a Community WiFi Network.

You understand that you may be able to access Optimum's third party roaming partners WiFi networks and agree that your use of such roaming partner WiFi networks will be subject to such roaming partner's terms and conditions of use, and are incorporated herein by this reference. You understand and agree that enhanced security while roaming may not be available on third party partner networks. You agree that your use of the Community WiFi Networks may be terminated or suspended by Optimum or its roaming partners, if Optimum or its roaming partners reasonably believe these Terms have been violated.

 

Performance of Community WiFi Networks

In order to use a Community WiFi Network, you must have a WiFi- capable device that:

  1. meets U.S. and other applicable technical standards;
  2. is compatible with the Community WiFi Network;
  3. renders web pages in a standard HTML browser application;
  4. runs the IP protocol; and
  5. is configured to obtain web addresses automatically.

The WiFi device must be in close enough proximity to the Community WiFi Network's wireless access points to achieve connectivity with the Community WiFi network. Community WiFi Network access location lists/maps may be updated from time-to-time. Actual Community WiFi Network coverage, locations and quality may vary.

As between Optimum and You, You agree that Optimum will use commercially reasonable efforts to provide useful, reliable, and secure Community WiFi Network service. Because the Community WiFi Networks utilize public, unlicensed radio-frequency spectrum, the Community WiFi Networks may be subject to external interferences, environmental influences, and other factors and variables beyond our reasonable control. Performance and availability may vary, including but not limited to or affected by:

  1. transmission and download speed and accuracy;
  2. network congestion;
  3. performance, configuration, and functionality of your WiFi devices and wireless cards (including, but not limited to memory, storage and other limitations);
  4. physical obstructions and distances between your WiFi device and the Community WiFi Network;
  5. availability of electric power;
  6. collocation failures;
  7. transmission and equipment limitations, failures, maintenance or repair; and
  8. user error

Community WiFi Networks may also be interrupted, refused, limited or curtailed for these reasons. We are not responsible for data lost or misdirected due to these and other foreseeable and unforeseeable factors. Network speed is an estimate and is no indication of the speed at which your WiFi device or the Community WiFi Network will operate. Actual network speed and other performance will vary. In order to maintain acceptable levels of service for all Community WiFi Network users and to improve this service, we reserve the right to monitor use of the Community WiFi Networks and to make such adjustments to the use of such services as may be necessary to maximize the benefit and enjoyment for all Community WiFi Network users. Additionally, consistent with the Community WiFi Network service may use automated processes to monitor and scan communications over the Community WiFi Networks in order to maintain and provide services, improve your experience, ensure the integrity of your communications, convey messages related to your account, deliver relevant advertising and for various other purposes related to the provision of Community WiFi Network services.

 

Optimum WiFi Passpoint and Optimum WiFi

Optimum WiFi Passpoint and Optimum WiFi (collectively, "Passpoint") allow you to automatically connect to Passpoint hotspots after you register a compatible mobile device and select a Passpoint hotspot. Thereafter, a properly registered mobile device will automatically connect when in range of an Passpoint hotspot using the provisioned credentials. You understand and agree that in the event a Passpoint hotspot is not in range or unavailable, you may be automatically connected to a non-Passpoint hotspot. In order to ensure a connection with enhanced security, you are responsible to check that you are connected to a Passpoint hotspot.

The Passpoint connections may be secured with WPA2-enterprise level authentication. You understand and agree that when connecting to Passpoint via an Optimum Router, that Optimum Router may be connected to a cable modem via a wired Ethernet connection (a "local" segment). All Ethernet traffic over this local segment will be reflected by the cable modem in an unencrypted form onto the cable network and be subject to eavesdropping. NOTE: there may be a limit to the amount of devices you may register for Passpoint depending on the Internet Tier for your Optimum Online service.

 

Service Subject To Interception and Unauthorized Use

You acknowledge that communications over the Community WiFi Networks may be subject to interception by unauthorized third parties. Although Optimum uses commercially reasonable efforts to provide you with a secure and reliable service, your use of Community WiFi Networks is AS IS and AS AVAILABLE and we cannot and do not make any general or specific warranties regarding the security, availability, performance or other functionality of Community WiFi Networks. You are responsible for security at the end user device while using a Community WiFi Network. Optimum expressly disclaims any responsibility or liability for your use of a Community WiFi Network and for any lack of security at the end user device that may result from your use of a Community WiFi Network, except in the case of Optimum’s gross negligence or willful misconduct.

You understand and agree that an Optimum WiFI, Optimum WiFi or other "watermark" bearing our logo may appear superimposed from time to time over portions of website pages you visit, that the watermark is intended solely to identify the relevant Community WiFi Network as the source of your wireless Internet access service, and that this in no way indicates Optimum's approval of or responsibility for the content of such websites, which are solely the responsibility of the website operators and/or content providers.

Optimum is not responsible in any way for any third party website content or the operation of any third party website accessed via a Community WiFi Network, or for the appearance of our "watermark" over a portion of any website.

 

Changes to Community WiFi Networks and these Terms of Use

You agree that Optimum may for any reason, and without notice to you, modify or terminate any Community WiFi Network and these Terms of Use without liability to you, any user or any third party.

We urge you to review these Terms of Use periodically so that you will be aware of any modifications.

 

OPEN INTERNET DISCLOSURE STATEMENT

The Federal Communications Commission ("FCC") requires that we provide you with the following information regarding Optimum's mass market retail broadband Internet access services, including information regarding network management practices that Optimum employs, the performance characteristics of our services, and the commercial terms of our service offerings.

The information provided below is intended for current and prospective subscribers to our services as well as providers of "edge" products (i.e., providers of applications, devices, services, and content accessed over or connected to Optimum's broadband Internet access service). Optimum may enter into arrangements to provide Internet service to third party establishments (such as coffee shops, bookstores, hotels, libraries, etc.) who then may offer such service to their customers, guests, or others. Nothing herein is intended to address the network management practices, performance characteristics, or commercial terms that may be adopted by such third party premises operators in connection with their provision of Internet service to others.

The information provided below may be revised from time to time as Optimum deems appropriate and should be read in conjunction with Optimum's Acceptable Use Policy ("AUP"), Agreement for Optimum Online, Agreement for Optimum Online for Business, Optimum WiFi Terms of Use for Subscribers and Optimum WiFi Terms of Use for Non-Subscribers.

 

Network Management

Optimum's Network and the Management of Our Network

Optimum manages its network in an attempt to ensure that all of its Subscribers have a high quality online experience. Optimum's online network is a bidirectional, shared network, the proper management of which is essential to promote the use and enjoyment of the Internet by all of our Subscribers. The potential for congestion which could adversely affect our network exists when users place an unusually heavy demand on the available network bandwidth. To this end, we employ a variety of reasonable and appropriate practices to protect Subscribers from activities that can unreasonably burden our network or cause service degradation, including network congestion and security attacks. These techniques include, but are not limited to (i) utilizing industry-standard subscriber traffic management technology to temporarily manage upstream and downstream traffic during times of peak congestion; (ii) implementing filtering and spam detection techniques to manage reliable email sources and mitigate spam; (iii) allocating a fixed maximum amount of bandwidth for the peer-to-peer upload of Subscriber files, especially during peak periods; and (iv) allocating a fixed maximum amount of bandwidth to the Subscribers in each service tier who consume disproportionate amounts of bandwidth for limited time periods. Optimum also employs certain automated processes to more evenly distribute the available bandwidth to users. Most Subscribers do not notice any change in their Internet experience as a result of these techniques and practices. Optimum reserves the right to modify these network management practices in its discretion and in accordance with law.

 

Usage Limits

In addition to managing network usage to ensure that the activity of a small number of Subscribers does not degrade, inhibit, or interfere with the use of the network by others and for the other reasons described above, Optimum maintains an excessive use policy to address data consumption by Subscribers that is wholly uncharacteristic of a typical user of the Service as determined by the company in its sole discretion. Common activities include numerous or continuous bulk transfers of files and other high capacity traffic using file transfer protocol ("FTP"), peer-to-peer applications, and newsgroups which result in excessive data consumption. Application Specific Behavior

Except in the circumstances described in the network management techniques above, Optimum does not block or degrade its Subscribers' ability to access lawful content or services or otherwise engage in any nonapplication-agnostic techniques, even with respect to non-Subscribers. Optimum reserves the right to employ network management practices to prevent certain harmful or illegal activity such as the distribution of viruses or other malicious code or the transfer of child pornography or other unlawful content.
