INFORMATION RELATING TO OPTIMUM'S MOBILE WIRELESS BROADBAND INTERNET ACCESS SERVICES

This web page contains important information about the terms, performance, and management of Optimum Mobile's wireless broadband Internet access services and is intended to help you to make informed choices about the purchase and use of these services. Broadband Internet access services provide Optimum customers with the ability to transmit and receive data from all or substantially all points on the Internet while using Optimum’s network and its partner radio access network facilities along with the “Optimum WiFi” network of WiFi internet access points (including “Altice WiFi”), and the WiFi networks of roaming third party partners who may provide access to their WiFi networks to Optimum Mobile subscribers.

In some cases, we will refer you to other web pages that will provide additional information about Optimum’s terms and practices. The information provided relates to your experience while using data networks managed by Optimum and may not describe the terms, performance, or management you may experience while using Optimum’s partner radio access network facilities, extended coverage networks or roaming on roaming partner networks.

Commercial Terms

Pricing and other terms and conditions for Optimum Mobile broadband Internet access. Optimum’s mobile service agreements and policies can be viewed at (https://www.optimum.com/terms-of-service/mobile). Pricing and options for Optimum’s mobile services can be viewed here (https://www.Optimum.com/mobile/plan). Optimum Mobile subscribers receive access to Optimum WiFi at no additional charge. If you use an in-home WiFi network along with a broadband service with a consumption allowance plan, use of the in- home WiFi network will apply toward any applicable bandwidth consumption allowance. Service is not available in all areas.

Rules regarding the attachment of devices to Optimum’s mobile network by customers. Any device that Optimum has certified as being compatible with its and its partner mobile network may be used on the Optimum Mobile network including compatible devices not purchased from Optimum. Optimum Mobile compatible devices can be found at https://www.optimum.com/mobile/bringyourownphone. Optimum will not activate devices that have been reported as lost or stolen or associated with accounts that are found not to be in good standing.

Depending on the capability of your device, using your Optimum service to create a mobile hotspot or tether your device to other connected devices is permitted pursuant to the terms, conditions and data pricing options of your Optimum service and subject to our network management practices. When you create a mobile hotspot to tether your device to other connected devices, your tethered device’s connection speed will be no more than 600 Kbps, except for our Unlimited Data plans (after 5/22/22) and Unlimited Max data plans. Performance

Over WiFi. When Optimum customers are connected using WiFi, performance management practices applicable to that connection will vary by Internet Service Provider ("ISP"). Optimum uses its best efforts to provide useful and reliable Optimum WiFi service over public, unlicensed radio- frequency spectrum. Optimum WiFi is subject to external interferences, environmental influences, and other factors and variables beyond Optimum's reasonable control and there is no guarantee that the Optimum WiFi will function without disruptions, delay, or other imperfections. Performance, speed and availability may vary or be affected by factors including but not limited to: (a) transmission and download speed and accuracy; (b) network congestion; (c) performance, configuration, and functionality of your devices and wireless cards (including, but not limited to memory, storage and other limitations); (d) physical obstructions and distances between your device and the Optimum WiFi network; (e) availability of electric power; (f) collocation failures; (g) transmission and equipment limitations, failures, maintenance or repair; and (h) user error. Optimum WiFi may also be interrupted, refused, limited or curtailed for these reasons. We are not responsible for data lost or misdirected due to these and other foreseeable and unforeseeable factors.

Optimum is not responsible for the performance management techniques used by other ISPs for their WiFi networks. If your device connects to another ISP's WiFi network, you should consult that provider's terms of service and broadband disclosures for information about their practices. When a device is utilizing Optimum’s WiFi to transmit data, text, image, audio and video files will be delivered over WiFi at the native resolution.

Over Mobile Network. Broadband Internet Access network performance is generally described by looking at two measurements – speed and latency. Speed refers to the amount of data that can be transmitted over a period of time and is typically expressed in megabits of data per second. Latency refers to the amount of time it takes for a packet of data to get from one designated point to another and is measured as the time it takes a packet to be returned to its sender in milliseconds. Network speed and latency determines how applications perform on a network.

Expected Optimum Mobile data networks performance. Optimum Mobile’s mobile broadband data services are offered to customers over the T-Mobile 4G LTE and 5G mobile broadband networks. 5G coverage is not available in all areas. You must have a 5G compatible device and be within 5G coverage area for 5G access. Devices operating on 5G network currently use multi-band connectivity; customers with 5G compatible devices will receive service via both the 4G LTE and 5G networks to support their connectivity.

Optimum Mobile coverage isn't available everywhere, and speeds and latency may vary considerably from these averages based on factors both within and beyond Optimum’s control such as network problems, software, signal strength, your wireless device, structures, buildings, weather, geography, topography, etc. It is important that you consider the capabilities of your device, Optimum’s underlying partner radio access network coverage, and Optimum’s typical speed range for mobile speed and latency estimates for Optimum’s mobile network technologies in determining whether Optimum’s mobile data services are right for you.

4G LTE network. Based on data publicly reported by T-Mobile, Optimum Mobile customers can expect to experience download speeds of 19-76 Mbps and upload speeds of 4-20 Mbps with an average device to network edge round-trip latency of between 24 – 40 ms. The average speed and latency of our 4G LTE network is suitable for video and audio streaming, web browsing and other general Internet usage consistent with Optimum’s terms and conditions.

5G Network. Based on data publicly reported by T-Mobile, Optimum Mobile customers with 5G-capable devices can expect to experience download speeds that are typically between 75 - 335 Mbps and upload speeds typically between 8 – 35 Mbps, with an average device to network edge round-trip latency of between 21 – 35 ms.

Optimum Mobile does not offer data plans other than 4G LTE, 5G and Optimum WiFi.

Performance with Optimum’s “By The Gig” Data Options. “By the Gig” data options provide limited data usage at a regular monthly rate per line (promotional rates may vary). Once the selected data allotment is used, speeds will be reduced to 2G speeds (e.g., 128 Kbps) for the remainder of the billing period, unless additional data is purchased. Subject to this speed reduction policy, use of your device as a WiFi hotspot plan will be no more than 600 Kbps speeds, and streaming video will be at DVD quality (480p).

Performance with Optimum’s “Unlimited” Data Options. Legacy Unlimited Everything plans and the "Unlimited GB" data option plan provide unlimited data usage at a regular monthly rate per line (promotional rates may vary). Speeds will be reduced to 3G speeds (e.g., 512 Kbps) after 20 gigabytes (GB) of data usage in a month for the remainder of the billing period after the allotment is exceeded. For mobile hotspot usage of Unlimited Data plans (after 5/22/22), speeds will be reduced to 3G (512 Kbps) after 5GB of data usage in a month for the remainder of the billing period after the mobile hotspot allotment is exceeded. Subject to this speed reduction policy, streaming video will be at DVD quality (480p). Video streaming speeds are standard definition when you have remaining data allotment, and then are reduced to 512 kbps when you fully consume your high-speed data allotment.

Performance with Optimum’s “Unlimited Max” Data Options. Speeds will be reduced to 3G speeds (e.g., 512 Kbps) after 50 gigabytes (GB) of data usage in a month for the remainder of the billing period after the allotment is exceeded. For mobile hotspot usage, speeds will be reduced to 3G (512 Kbps) after 15GB of data usage in a month for the remainder of the billing period after the mobile hotspot allotment is exceeded. Subject to this speed reduction policy, streaming video will be at HD quality (720p).

Network Management

Optimum is committed to providing the best mobile broadband Internet access service experience possible. To ensure that all Optimum customers enjoy the best possible network experience, Optimum uses reasonable network management practices that are consistent with guidance provided by the Federal Communications Commission (FCC). Optimum’s mobile network management practices are primarily used for and tailored to achieving legitimate network management purposes taking into account Optimum’s network and its underlying partner’s radio access network architecture and technology.

The following is intended to help you understand Optimum’s network management techniques and approaches.

Why is network management needed? Optimum manages access to the mobile network with the goal of delivering the best possible mobile broadband Internet access experience to our customers. Managing the network is essential to promote the use and enjoyment of mobile data by our customers. We use reasonable network management practices for protecting Optimum’s mobile network and customers and for managing the delivery of mobile broadband services.

Optimum’s Partner Radio Access Network Provider Techniques to Direct Traffic to the Best Available Spectrum Resources and Cell Sites and Allocate Cell Sector Resources: All mobile networks, including Optimum’s underlying partner radio access network, manage connectivity between mobile client devices and the network. The radio access network functions to identify mobile devices permitted to access the network and their locations and assigns the mobile device to an available frequency band and cell site serving the location. The radio access network also controls device “hand off” between neighboring cell site resources to balance load across network resources or as a mobile device moves from one location to another. Optimum’s partner radio access network manages connections between mobile devices and cell sites operating on multiple frequency bands. As part of managing those connections, Optimum’s partner radio access network is designed to dynamically connect customers to the best available spectrum resources and cell sites—and reassign those connections as circumstances change. Optimum’s partner radio access network provider also relies on radio scheduling software to allocate cell sector resources to users. This radio scheduling software includes a set of generic fairness algorithms that allocate resources based on signal quality, number of users, and other metrics. These algorithms are active at all times, whether or not the cell is congested; however, during times of congestion, the algorithms operate with the goal of ensuring that no single user is deprived of access to the network.

Quality of Service (QoS): Optimum employs reasonable network prioritization or QoS practices on the mobile network. 1 GB or 3 GB data plan customers who use more than their allotted monthly data during a single billing cycle will have their speeds reduced to 2G speeds. Unlimited data customers who use more than 20 GB of data or Unlimited Max customers who used more than 50 GB of data during a single billing cycle will have their speeds reduced to 3G speeds for the remainder of that billing cycle. Affected customers will continue to be able to enjoy unlimited amounts of data at 2G or 3G speeds for the remainder of that billing cycle, as noted above.

  • No Affiliated Prioritization. Optimum does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, to benefit an affiliate.
  • No Paid Prioritization. Optimum does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, in exchange for consideration, monetary or otherwise.
 

Optimum prohibited applications and uses. Optimum’s mobile broadband internet access services are intended to be used for web surfing, sending and receiving email, photographs and other similar messaging activities, and the non-continuous streaming of videos, downloading or uploading of files or online gaming. To ensure the activities of some users do not impair the ability of our customers to have access to reliable services, Optimum prohibits use of our mobile services in a manner that is illegal, harms or unduly interferes with Optimum or its underlying partner network or systems, poses a security risk, or is otherwise prohibited by our terms and conditions or acceptable use policy. Refer to our Customer Service Agreement for more information.

Application Specific Behavior. Except in the circumstances described in the network management techniques above, Optimum does not block or degrade its subscribers' ability to access lawful content or services or otherwise engage in any non application-agnostic techniques, even with respect to non-subscribers. Optimum reserves the right to employ network management practices to prevent certain harmful or illegal activity such as the distribution of viruses or other malicious code or the transfer of child pornography or other unlawful content.

Despite the actions that Optimum takes to protect its network and customers, Optimum cannot guarantee that you may not encounter unwanted or harmful or malicious internet traffic while using Optimum’s mobile broadband Internet access services. We encourage you to engage in your own security practices including using antivirus/antimalware products.

Important notice about domestic data use while off the Optimum network. While an Optimum customer’s mobile device is connected to another provider’s mobile network (“off-network” or “domestic roaming”) speeds will be up to 2G. We do not guarantee the availability, quality of coverage or speed for roaming Services that are accessed using other mobile network provider networks.When off-network and roaming, the mobile device’s network display will change from “Optimum Mobile” “Altice WiFi” or “Optimum WiFi” to the name of another carrier (e.g., “AT&T”).

Data use will remain at 2G speeds until the customer returns to an Optimum coverage area (up to two hours after). This does not impact: (1) voice usage, and (2) data usage on the Optimum Mobile network.

Off-network data use may occur even when you are within the Optimum coverage area. See your device’s user manual for directions on how to update device settings to avoid domestic roaming.

Important notice about international data use. While an Optimum customer’s mobile device is connected to another provider’s mobile network that is outside of the United States, that jurisdiction’s privacy laws may apply.

Security

The Optimum WiFi connection is secured with WPA2-enterprise level authentication.

Optimum works to protect the network against outside attacks, tampering, malicious activity, and network events that may in any way disrupt or degrade Optimum customers' ability to use the network. Optimum may block a limited number of Internet addresses that are disruptive or malicious and typically persistent, based on analysis and third-party intelligence. Unless requested by the subscriber, Optimum does not block lawful traffic based on content. Optimum regularly reviews and modifies the list of blocked Internet addresses, taking any off the list that are no longer perceived as a threat.
